Clause added to 6.04.1. Breach and Liquidated Damages
The BUYER expressly warrants that they are acquiring the PUPPY for themselves and for the sole purpose of companionship, not for resale, transfer, or placement with any third party engaged in puppy milling/farming, nor for any purpose that would constitute a breach of Clause 6.04. Should the BUYER, or any third party acting on the BUYER’S behalf (whether directly or indirectly), resell, transfer, or place the PUPPY in a puppy mill or for puppy milling/farming purposes, the BUYER shall be in immediate and material breach of this Contract. In such an event, the BUYER agrees to pay the SELLER liquidated damages in the amount of $15,000.00 AUD as a genuine pre-estimate of the loss and damage suffered by the SELLER. This loss includes, but is not limited to, severe damage to the SELLER’S ethical standing and reputation, the profound emotional distress, the cost of potential legal and remedial actions required, and the inherent welfare compromise of the PUPPY. This sum is not a penalty. The SELLER reserves all other rights and remedies available at law or in equity.
Section 2. Warranties and conditions added:
2.01. The PUPPY is SOLD ‘AS IS’. This means the BUYER accepts the PUPPY in its present condition at the time of sale. As the SELLER is a hobby breeder, this transaction is not subject to the consumer guarantees typically offered under the Australian Consumer Law.
The SELLER provides no other warranties, whether directly stated (express) or legally implied. This includes, but is not limited to, any implied warranty regarding general quality, health, or suitability for any specific purpose. The BUYER confirms they have satisfied themselves regarding the PUPPY’S condition, health, and suitability for their intended purpose prior to purchase.
The SELLER assumes no liability, nor authorises any other person to assume liability on the SELLER’S behalf, in connection with the sale of this PUPPY beyond the terms expressly stated in this CONTRACT. As the PUPPY is a living animal and not a manufactured product, no manufacturer’s warranties apply.
2.02. The SELLER offers an assessment of the PUPPY’S potential based on breed characteristics, lineage, and early development. However, the BUYER acknowledges and agrees that the future growth, conformation, temperament, and performance capabilities (e.g., for showing, breeding, or specific work) of a living animal cannot be guaranteed. These aspects are significantly influenced by genetics, environment, diet, training, and ongoing care provided by the BUYER. It is the BUYER’S responsibility to make their own assessment of the PUPPY’S suitability for their intended purpose prior to purchase. This PUPPY is primarily offered as a companion animal, and any discussions or expectations regarding its suitability for specific roles are estimates only and do not constitute a warranty or guarantee by the SELLER.
2.03. The SELLER actively participates in X-ray backscoring programs to statistically reduce the risk of Intervertebral Disc Disease (IVDD) in our breeding lines. While this is a valuable tool that guides our breeding decisions towards lower-risk individuals, the SELLER cannot guarantee that any PUPPY from these lines will be entirely free from IVDD issues in its lifetime. IVDD is a complex condition influenced by multiple genetic factors and environmental elements. The BUYER acknowledges that purchasing a PUPPY from backscored lines is a step towards risk reduction, not a guarantee of IVDD absence.
Section 3. Health and welfare added:
3.01. The BUYER(S) is/are strongly advised to take the PUPPY to their vet, within three (3) WORKING DAYS after purchase, for a general check and advice on inoculations, worming and training.
3.02. The SELLER is not responsible for any adverse reactions to any products given or recommended.
3.03. Genetic Health Testing
The SELLER diligently conducts DNA testing on the breeding parents for genetic conditions relevant to the Miniature Dachshund breed, including Progressive Retinal Atrophy (PRA cord1) and Sarcoglycan Deficient Muscular Dystrophy (SDMD). The SELLER’S breeding program is designed to avoid breeding two (2) CARRIERS together, thereby ensuring that no PUPPY produced will be AFFECTED by these specific conditions.
However, the SELLER may breed dogs that are CARRIERS for PRA cord1 and/or SDMD with non-carrier (Clear) dogs. Consequently, some PUPPIES from such pairings may inherit one (1) copy of the gene and therefore be CARRIERS for PRA cord1 and/or SDMD. A CARRIER PUPPY is not affected by the disease and will not develop the condition itself, but can pass the gene to its offspring if bred.
The SELLER will provide DNA test results for the PUPPY’S parents upon request. Should the BUYER wish to determine the specific carrier status of their individual PUPPY prior to purchase (e.g., to ensure a non-carrier for future breeding purposes), it is the BUYER’S responsibility to request and pay for any additional DNA testing on the PUPPY. Such testing must be arranged and completed at the BUYER’S sole expense and prior to the finalization of the sale.

2.04. The SELLER recommends Sentinel Spectrum; once monthly chewy. For the PUPPYS protection against fleas, heartworm and internal Parasites including 2 types of tapeworm; as the brand 100% guarantees their product for safety and protection.
2.05. SELLER is not responsible for any adverse reactions to any products given or recommended.
Section 4 Potential of Dog removed
4.01. SELLER makes no other guarantees or representations as to this PUPPY’S success in the show ring or any other performance venue, nor does SELLER make any representation or guarantee concerning this PUPPY’S weight, size, back score, IVDD risk, future health, future fertility or breeding potential.
4.02. SELLER makes no guarantees that PUPPY is free from disqualifying faults per the Dogs Australia bree
